<title>Access to a lawyer: European Parliament urged to oppose Council’s erosion of citizens’ right to confidentiality</title>

<description>The Council of Bars and Law Societies of Europe (CCBE) is the representative organisation of around 1 million European lawyers through its member bars and law societies from 31 full member countries, and 11 further associate and observer countries. The CCBE is alarmed by the recent EU Council&amp;rsquo;s position of 8 June regarding the proposed Directive on the right of access to a lawyer in criminal proceedings and on the right to communicate upon arrest.  In stark contrast to the original proposal from the Commission, the Council's text of 8 June falls dramatically below the standards set by the jurisprudence of the European Court of Human Rights, including internationally accepted standards in relation to the right of access to a lawyer and legal assistance, thus turning the proposed measure into the very opposite of its intended purpose. </description>

<description>The European Commission has made available to the public this week, on the European e-Justice portal, national factsheets on the rights of defendants in all 27 Member States of the EU. These factsheets were prepared by the Council of Bars and Law Societies of Europe (CCBE) working together with experienced criminal defence lawyers, the CCBE's member Bars, Ministries of Justice and qualified legal translators. They list in a simple but comprehensive way the rights available to defendants in criminal proceedings in all the EU Member States. They are available in all of the EU&amp;rsquo;s official languages.</description>

<title>European lawyers respond to the 5 Member States which oppose the draft Directive on the right of access to a lawyer</title>

<description>The Council of Bars and Law Societies of Europe (CCBE) is alarmed with the recent position taken by five Member States regarding the proposed Directive on the right of access to a lawyer in criminal proceedings and on the right to communicate upon arrest. The five Member States &amp;ndash; France, Belgium, the Netherlands, United Kingdom and Ireland &amp;ndash; expressed &amp;ldquo;serious reservations about the Commission&amp;rsquo;s approach&amp;rdquo; which, in their view, &amp;ldquo;would present substantial difficulties for the effective conduct of criminal proceedings&amp;rdquo;. This is despite the fact that two of the five countries (the United Kingdom and Ireland) would be concerned only if they chose to opt in the Directive. The CCBE has issued detailed comments in response to the issues raised by the five Member States.</description>
